Thousands of cases have been resolved in speedy trials across India administered Jammu and Kashmir, bringing Kashmiri Muslims late justice and settling years-old conflicts.
“We got the dispute settled in Lok Adalat today and decided to live like a good humans,” Gani Khanday, who had a land dispute with his relative Rasool Lone, told OnIslam.net.
Rasool Lone was also happy that the 12-year-old dispute has been finally solved.
“I have spent more than 30 thousands till now but today I could understand that compromise is the best way and one must compromise with life also as life also fades some time and we all have to die one day,” he said.
The case of Khanday and Rasool was one of more than 58 thousand cases which were settled on Saturday, November 23, in Kashmir Lok Adalat.
Headed by Justice Virender Singh, the National Legal Services Authority (NALSA) Saturday organized the National Lok Adalat, speedy justice, across the country.
The sessions were attended by advocates, standing counsels of respective Banks/ departments, and large number of litigants/claimants.
“In both wings of High Courts in Jammu and Kashmir and in all 22 District Legal Services Authorities, 58403 cases were settled and total compensation of Rs 29.2655656 Crore was awarded to victims of Motor Accidents,” official press release said here.
For many Kashmiri Muslims, the court sessions rescued them from years-old litigation processes which consumed their time and money.
For Zeba, a Kashmiri woman who had a dispute with her neighbor Hamidullah on just one Marla of land, the Lok Adalat played role of an angle as her ten year old case got decided on compromise basis in Subordinate court of Qazigund in south Kashmir.
“I am thankful to Munsiff Raj Kumar Lalhal who makes me to understand that prolonged litigation is not a way to resolve the disputes and we finally distribute the land and I got 100 feet while my opponent got 80 feet of land,” she told Onislam.net.
“Had we compromised the matter earlier we could have saved both time and money.”
For many Muslims, these types of Adalats are best way to resolve the disputes provided one shuns his ego and enter into compromise.
“I am happy that my case got settled today had I been able to compromise earlier I could have save both money and time as well,” Gh Hassan told Onislam.net, adding that prolonged litigation is always fatal for both parties.
Life in Distress
During the last twenty three years of turmoil, people in Kashmir witnessed social changes and due to the frustration the happy couples finding no other way fall in the litigations which ultimately ruin their matrimonial life.
“I am highly thankful to the Indian Judiciary and Legal services Authority who came to my rescue and I could resolve the pending dispute with my wife in today’s Lok Adalat,” Mohd Altaf Kela, from Rajpora village of district Pulwama, said.
He said just four months of his marriage his wife left him alone and it took three years to settle down the dispute.
In another similar matrimonial dispute one lady Shakeela who was married with Mohd Yousf got justice after four years when her case was settled in Lok Adalat at Doru Court which was presided over by Chairman Tehsil Legal Service Authority, Javid Rana Hakla.
“I am thankful to the legal Service Authority and The fast growing justice delivery system of the Country as I could get justice today,” Shakeela told Onislam.net.
Shakeela problem started four years ago when her husband contracted second marriage and deserted her.
“It is really a miracle that the dispute of Shakeela and her husband Yousf got resolved,” Advocate Nadeem Jan told Onislam.net.
In another case, Samena Bano Verses Mohd Ashraf the marriage was dissolved with the consent of the parties in Pulwama district of south Kashmir.
Living in desertion, Samena had married with Ashraf eight years back and within the two years after the marriage, some dispute arises among the couple.
“I live miserable life as my husband contracted second marriage without my consent and forced me to live in desertion at my parental house,” Samena told Onislam.net adding thanks to the counsels and Judges who settled down my case permanently.
“At least I will live a happy life instead living in desertion,” she added.
New Hope
Bringing a speedy justice, Lok Adalat was praised as a huge success for legal service authority.
“Organizing Lok Adalats is a big initiative in Judiciary as people get speedy justice in pending case on compromise basis,” Advocate Mushtaq Ahmad practicing in Pulwama district court told Onislam.net, adding the step minimizes the number of litigations and also give sigh of relief to the litigants.
“Main aim of holding the speedy justice delivery system in Kashmir is to minimize the number of long pending cases in courts besides informing people about the efficacious alternative dispute resolution method LOK ADALAT,” Advocate Farhat Zeya told Onislam.net.
He said when one moves a step forward the dispute gets resolved in movements.
Speedy trials have also brought new hope to poor Muslims who cannot afford money for years of litigation.
“In Lok Adalats no distinction made between rich and poor, we cannot overlook poor people who suffer because of their poverty as they live in pain of loan all the times,” Advocate Bashir Ahmad Rather told Onislam.net
He said that rich Barrowers always take things easily while the poor has feels shy when the banker goes to his door for the recovery.
“People should come forward to take advantage of the National Lok Adalat and Pre-Litigation Compromise this will definitely ease their worries,” says Syed Noordin a religious Scholar.
“Poor people always pay back loans while rich take easy note of the liabilities,” he said adding loan amount left grows like anything as the interests mar the loanee.
